“We,” “us,” “our” and “AmeriTrust Auto” mean AmeriTrust Auto and its respective successors and assigns. “You” and “your” means the person giving this consent. “Records” means all documents related to the origination and servicing of a leased motor vehicle from AmeriTrust Auto, such as your credit application, adverse action and credit score notices, your closed-end lease agreement, consumer disclosures, billing statements, online bill payments and payment authorizations, transaction histories, privacy policies, and all other communication or information related to the product or service you obtain from us, including any records we are required by law to provide to you in writing.
By giving your consent, you agree to conduct all transactions involving your lease account with AmeriTrust Auto electronically, including using electronic signatures. You agree that such electronic signatures will consist of clicking on buttons and/or checking boxes where indicated. You also consent to the use of electronic Records, including Records sent to you electronically, instead of receiving them on paper or by regular mail. We may provide Records to you electronically by posting them online or by email, which may include the Records as attachments or as embedded links. Your consent will be effective unless you withdraw it in the manner provided below.
You agree to provide us with your accurate email address and personal contact information and to promptly notify us of any changes. You can update your information (including your email address) on our website or by contacting us at 866-520-9314. If email is undeliverable to your email address for three consecutive months, your consent will be considered withdrawn and we will send you future Records in writing.
You may obtain a paper copy of a Record by printing it from your computer or by contacting us at 866-520-9314. We may charge you a reasonable service charge for providing you with a paper copy of any Record. The request for a paper copy of a Record will not by itself constitute a withdrawal of your consent to receive Records electronically. We reserve the right, but are not required, to send a paper copy of any Record you authorize us to provide electronically.
You may at any time withdraw your consent to receive Records electronically, and instead elect at any time to use the U.S. Postal Service to obtain Records by contacting us at 866-520-9314. We will not impose any fee if you withdraw your consent to receive Records electronically but our communications with you may be slower. If you withdraw your consent to receive Records electronically, such withdrawal will not apply to Records that were furnished to you electronically before the date on which the withdrawal of your consent takes effect.
To use electronic signatures and Records you need to have a computer that supports the use of Microsoft Internet Explorer 7.0 or higher, Mozilla Firefox 3.5 or higher, Chrome, Safari 5.0 or higher, or an equivalent. You will need an active email account. You also need hardware as necessary to support this software, including, without limitation, a personal computer using a Windows 98, NT, 2000, ME XP, Vista or 7 operating system that supports 128-bit encryption, sufficient storage space to save copies of your Records, a modem with internet access, and a printer if you wish to print paper copies. You will need a program that can view, save and print PDF files (such as Adobe Reader 6.0 or higher). You can download a copy of Adobe Reader here: http://get.adobe.com/reader. Save and print a copy of this document to make sure that you have the necessary hardware and software. If we ever change the hardware or software requirements for using electronic Records and signatures, the revised requirements will be posted online upon your next session log in. By providing us your current email address and accessing this Agreement on this website, you confirm that you have the required hardware and software to conduct electronic transactions with us.
By checking the box, you authorize AmeriTrust Auto to deliver advertisements and/or telemarketing calls and text message to the telephone number you have provided using an automated telephone dialing system or a prerecorded or artificial voice. You acknowledge and confirm that you have the authority to provide this consent because you are either the subscriber of the telephone number(s) or you are the non-subscriber customary user who has authority to provide this consent. If you change your telephone number(s), you agree to contact us immediately to advise us of any such change. You understand that you are not required to provide this authorization as a condition of obtaining credit or any other product or service from us.
Scope and Definitions. This is an application for credit for a lease contract submitted to AmeriTrust Auto (“Application”). The words “we,” “us,” “our,” and “AmeriTrust Auto” means and includes AmeriTrust Auto, its affiliates, its designated service providers, agents, assigns and successors, as applicable. The words “you” and “your” mean each applicant (as individuals) and both applicants (collectively) shown above and submitting this Application.
You agree that everything stated in this Application is true and complete. You certify that you are the age of majority in your state of residence.
Consumer Reports and Other Information. You authorize us to obtain credit or similar reports from one or more consumer reporting agencies in connection with this Application. Upon request, you will be informed of whether or not we obtained a consumer report and, if so, the name and address of the consumer reporting agency that furnished that report. If your Application is approved, you also authorize us to obtain additional credit reports and other information about you in connection with reviews, updates, extensions, renewals, modifications, collection activities of any credit that we extend to you or for any legitimate purpose. You further authorize us to verify with others any information contained in your Application and to provide information about your Application to third parties (including consumer reporting agencies or potential assignees of any credit that we extend to you) for lawful purposes. You agree that your submission of this Application constitutes your approval for us to obtain and share such information. We may report information about your account to credit bureaus. Late payments, missed payments or other defaults on your account may be reflected in your credit report.
Servicing and Collection Communication Consent: You agree that we may monitor and record telephone calls regarding your account to assure the quality of our service or for other reasons. By providing the number of your land line, cell phone or other wireless device and your email address, you expressly consent and agree that we may call you, using an automatic telephone dialing system or otherwise, leave you a voice, prerecorded, or artificial voice message, or send you a text, e-mail, or other electronic message for any purpose related to the servicing or collection of any account that you may establish with us or for other informational purposes related to your account (each a “Communication”). You agree that we may call or text you at any telephone number associated with your accounts, including cellular telephone numbers, and may send an e-mail to any email address associated with your accounts that you provide to us now or in the future. You also agree that we may include your personal information in a Communication. We will not charge you for a Communication, but your service provider may. In addition, you understand and agree we may always communicate with you in any manner permissible by law that does not require your prior consent. You acknowledge and confirm that you have the authority to provide this consent because you are either the subscriber of the telephone number(s) or you are the non-subscriber customary user who has authority to provide this consent. If you change your telephone number(s), you agree to contact us immediately to advise us of any such change.
State Law Notices.
California Residents. If you are married, you may apply for a separate account.
Ohio Residents. Ohio laws against discrimination require that all creditors make credit equally available to all creditworthy customers and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law.
Maine, Rhode Island and Tennessee Residents. You must have the liability insurance coverage as described in your lease contract or other documents provided by the lessor describing the coverage requirements. You may purchase required insurance through any insurance agent or broker and from any insurance company that is reasonably acceptable to us. You are not required to deal with any of our affiliates when choosing an agent, broker or insurer. Your choice of a particular insurance agent, broker or insurer will not affect our credit decision, so long as the insurance provides adequate coverage with an insurer who meets our reasonable requirements.
